Do you need to make a photo?

Do not prepare a separate photo unless the state agency or your transaction instructions specifically ask for one. The agency procedure below describes where a photo is captured and what is known about remote renewal.

This page covers a driver license. It does not automatically apply to learner permits, state identification cards, commercial endorsements, or every exception.

Photo law and requirements

North Dakota Century Code § 39-06-14(4) requires the operator's license to bear a color photograph of the licensee, which may be produced by digital imaging and is not a public record; it lets the director adopt rules on how photographs are obtained. § 39-06-19(9) lets a noncommercial applicant renew by mail or electronically during every other renewal cycle, and § 39-06-19(10) bars mail or electronic renewal when the applicant is seeking a new photo or changes to the information on the face of the license. The photo statutes were reviewed; North Dakota administrative rules on photographs have not been reviewed.

Where the photo is taken

NDDOT offers in-person renewal at Driver License Sites and warns that glasses are not allowed in photos. That points to agency photo handling at an office visit, but the renewal page does not say whether every renewal captures a new portrait or reuses one on file. Do not bring a print unless NDDOT asks.

Online renewal, photo reuse, and upload

Eligible drivers may renew online. NDDOT’s public renewal page does not say whether online renewal reuses the stored photo or offers a new-photo upload. A photo is required for an original license, and a new photo is expressly required for certain non-renewal transactions such as some name changes.

New photo upload: Only treat upload as allowed when the linked official instructions explicitly say so.

Scope and limitations

The source does not establish a photo-update interval or remote image method. Confirm with NDDOT for your specific transaction; full statute and rule review remains pending.
