New York Driver License Photo Requirements

Do you need to make a photo?
Do not prepare a separate photo unless the state agency or your transaction instructions specifically ask for one. The agency procedure below describes where a photo is captured and what is known about remote renewal.
This page covers a driver license. It does not automatically apply to learner permits, state identification cards, commercial endorsements, or every exception.
Photo law and requirements
New York Vehicle and Traffic Law § 504(1)(b) authorizes the commissioner to require by regulation that every driver's license contain the licensee's photo image, and § 502(1) lets the commissioner include the taking of a photo image of the applicant in the application procedure, under the commissioner's rules. On renewal, § 502(6)(a) requires a photo image only if the commissioner requires one, in the number and form the commissioner prescribes. § 503(2)(f) sets a $12.50 fee for processing each license document requiring a photo image. The photo statutes were reviewed; the commissioner's photo regulations (15 NYCRR) have not yet been reviewed.
Where the photo is taken
If a driver wants to update the photo, NY DMV requires an office visit.
Online renewal, photo reuse, and upload
Eligible online renewal keeps the image on file; there is no applicant portrait upload route in the reviewed renewal instructions.
New photo upload: Only treat upload as allowed when the linked official instructions explicitly say so.
