Do you need to make a photo?

Do not prepare a separate photo unless the state agency or your transaction instructions specifically ask for one. The agency procedure below describes where a photo is captured and what is known about remote renewal.

This page covers a driver license. It does not automatically apply to learner permits, state identification cards, commercial endorsements, or every exception.

Photo law and requirements

Idaho Code § 49-315(1)–(2) requires every driver license to bear a color photograph and says the examiner takes it when the application is made. This identifies an examiner-controlled capture for an in-person application; the statute does not explain how the photo requirement is met when an eligible Class D renewal is submitted electronically. IDAPA 39.02.76 allows qualifying electronic renewals, while ITD says photos are retained for ten years. The reviewed sources do not establish a general applicant-upload path or conclusively describe remote image reuse. The photo statute and renewal rule were reviewed; remote implementation remains unresolved.

Where the photo is taken

Idaho Code § 49-315(2) requires the license photo to be taken by the examiner when the application is made. First-time applicants and Star Card upgrades must follow county office instructions. ITD says the image is stored securely for ten years; public guidance does not establish that every in-person renewal takes a new photo.

Online renewal, photo reuse, and upload

Eligible Class D renewals can be completed online through an Idaho DMV account under IDAPA 39.02.76. The reviewed portal guidance does not describe a new-photo upload, and the law’s examiner-at-application wording does not explain how the image is handled for an electronic renewal. ITD says photos are retained for ten years, but does not clearly confirm reuse for each remote renewal. Do not make a photo unless ITD requests one.

New photo upload: Only treat upload as allowed when the linked official instructions explicitly say so.

Scope and limitations

The photo retention period is stated by the agency; the exact portrait handling for each renewal transaction remains unclear in public instructions. A photo used for account identity verification should not be assumed to become the credential image.
